To file for legal separation in California, one spouse files a Petition (Form FL-100) selecting legal separation rather than dissolution, along with the summons and, if there are children, the UCCJEA form, and serves the other spouse. Unlike a divorce, a legal separation has no six-month residency requirement, so you can file as soon as you live in California. The case then proceeds much like a divorce, resolving property, support, and custody, but ends with a judgment of legal separation rather than a dissolution of the marriage.
