Parental Alienation in California — Signs, Proof, and Court Remedies

Parental alienation signs in California custody cases include one parent systematically undermining the child's relationship with the other parent through manipulation, false allegations, interference with parenting time, and programming the child to reject the targeted parent. Family Code section 3020 requires courts to ensure children have frequent and continuing contact with both parents — making parental alienation a serious legal issue.

Parental Alienation Signs — What to Look For

Common parental alienation signs: the child suddenly refuses to visit a parent they previously had a positive relationship with; the child uses adult language to criticize the targeted parent; the alienating parent schedules conflicting activities during the other parent's time; the alienating parent makes false allegations of abuse; the child is used as a messenger or spy; the alienating parent interferes with phone calls and communications. Additional parental alienation signs in a child include anxiety, depression, and loss of connection with the targeted parent's extended family.

Proving It and What Courts Do

Evidence: co-parenting app records showing interference; text messages; school and medical records showing the targeted parent was excluded; witness statements; and a custody evaluation under FC §3111. California courts respond to proven parental alienation with: custody order modification giving the targeted parent more time; family therapy focused on reunification; appointment of a parenting coordinator; in severe cases, switching primary custody; and attorney fee sanctions against the alienating parent.
