Primary Custody vs Sole Custody in California — Key Differences

Primary custody vs sole custody is a distinction that confuses many California parents. The terms are related but not identical, and understanding how California courts use each helps parents negotiate parenting arrangements more effectively.

What Is Primary Custody in California?

Primary custody — sometimes called primary physical custody — means the child lives primarily with one parent. The child has a "home base" with the primary custodial parent and spends less time with the other parent, who has secondary custody or visitation. Primary custody does not mean the other parent has no rights — it simply establishes where the child primarily resides. A child can have a primary custodial parent while both parents share joint legal custody (decision-making).

Primary Custody vs Sole Custody — The Difference

Primary custody vs sole custody differs in the degree of exclusivity. Primary custody means one parent has more time, but the other parent still has significant scheduled visitation — perhaps every other weekend, one weekday overnight, and half of school breaks. Sole physical custody means the child lives exclusively or almost exclusively with one parent, with the other parent having only supervised visitation, very limited contact, or no contact at all. Sole custody is a more restrictive arrangement typically ordered when the non-custodial parent poses a safety risk.

Sole Legal Custody vs Joint Legal Custody

Legal custody — the right to make decisions about the child's health, education, and welfare — is separate from physical custody. Courts can order primary physical custody to one parent while maintaining joint legal custody for both parents. Sole legal custody gives one parent exclusive decision-making authority and is ordered less frequently than sole physical custody — typically only when the parents cannot communicate at all or one parent has a history of domestic violence or abuse.
